Sibanye-Stillwater can be used as an example of an overactive mining complex. The PIC is the largest stakeholder. Following in second place is Blackrock. It is not known who represents their interests on the board. Most of the non-executive board members also sit on this committee. Analyzing the background of the non-executive board members on the Safety and Health Committee suggests the extreme importance of this portfolio for the stakeholders. It is the pensioners' money they are using. Reflecting on the public comments by the Sibanye-Stillwater CEO, it seems that this committee has very specific views on how they foresee how SA must be governed.
Safety seems to be struggling with illegal mining and cable theft. It seems that is where the interest in Safety and Health stops. Both are illegal economic activities associated with liberation movements. In conjunction with other specific crime activities in areas of operation, the methodology used to address their problems with lawlessness should necessitate alternative law enforcement approaches.
Independent non-executive board members should have no input in the company's day-to-day running. They are supposed to monitor the executive and represent the stakeholders' interests.
Liberation Movement wrote itself out of the economy with the deals it made with businesses. Businesses representing the Mining and Energy complexes initiated negotiating blocs to position themselves (first steps of state capture) to extract economic advantage from the negotiated processes.
Looking at the Mining complex with a focus on Sibanye, the leadership looks more like a business think tank involved in collapsing the ANC and the SA government.

Measuring their “solutions” against these activities indicates that the private sector and government cannot fix lawlessness. These variables must be included in a solution and implemented in a specific sequence. It is not happening.
The government (ANC) and businesses (BUSA, B4SA, BLSA, and others) do not address the variables that JPMC identified as key to a turnaround strategy for lawlessness.
